1. Acceptance of Terms

By accessing or using Market4Me.ai (“the Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Market4Me.ai is an AI-powered marketing platform that enables businesses to generate video content, manage social media campaigns, analyse brand performance, and create AI-driven marketing assets. The Service includes AI video generation, brand intelligence analysis, content scheduling, and related features (collectively, the “Service”).

3. Subscriptions and Billing

3.1 Subscription Plans

The Service is offered on a subscription basis. Plans are billed monthly or annually depending on the option you choose, and automatically renew at the end of each billing period unless cancelled. Current plan pricing is displayed on the pricing page and within your account settings.

3.2 Credit System

Each subscription plan includes a monthly credit allowance. Credits are used to generate video content and other AI-powered outputs. Monthly credits refresh at the start of each billing cycle and do not roll over — unused monthly credits are forfeited at the end of each cycle.

You may also purchase additional (“top-up”) credits as a one-time payment. Purchased top-up credits do not expire while your subscription remains active. If your subscription is cancelled, purchased credits remain available for 90 days after cancellation, after which they are forfeited.

3.3 Payment Processing

All payments are processed by Stripe, Inc. By subscribing, you authorise us to charge your payment method on a recurring basis. You are responsible for maintaining a valid payment method. If payment fails, your access may be suspended after reasonable notice.

3.4 Price Changes

We may change subscription pricing with at least 30 days' notice. Price changes take effect at your next renewal. Continued use after the effective date constitutes acceptance of the new pricing.

4. Cancellation

You may cancel your subscription at any time via your account billing settings or by contacting support. Cancellation takes effect at the end of the current billing period — you retain full access until then. No partial refunds are issued for unused time within a billing period, except where required by applicable law (see our Refund Policy for EU/UK consumers).

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, defamatory, harassing, or violates any third-party rights
• Create deepfakes or non-consensual synthetic media of real individuals
• Produce content that violates Meta, TikTok, YouTube, or any platform's community guidelines
• Infringe intellectual property rights of any third party
• Circumvent technical restrictions or access controls
• Resell or sublicense the Service without our written consent
• Use the Service for automated spam campaigns or mass unsolicited messaging
• Upload or process content depicting minors in any sexual context

We reserve the right to suspend or terminate accounts found in violation of this policy without notice and without refund.

6. AI-Generated Content

6.1 Ownership

Subject to these Terms and your compliance with our Acceptable Use Policy, you own the AI-generated outputs produced through your use of the Service. We claim no ownership over content you generate.

6.2 Licence to Us

By using the Service, you grant us a limited, non-exclusive licence to process, store, and transmit your content solely to provide the Service. We do not use your content to train AI models without your consent.

6.3 AI Limitations

AI-generated content may contain inaccuracies, errors, or unintended outputs. You are responsible for reviewing all AI-generated content before publishing. Market4Me.ai is not liable for any consequences arising from AI-generated outputs you choose to publish.

6.4 Third-Party AI Providers

The Service uses third-party AI video generation models (including but not limited to Seedance, AtlasCloud, ElevenLabs). Use of these models is subject to their respective terms of service, particularly restrictions on generating content with realistic human faces without proper consent.

7. Intellectual Property

Market4Me.ai and its underlying technology, branding, and software are owned by us and protected by intellectual property laws. You may not copy, modify, reverse-engineer, or create derivative works of the Service without our written consent.

8. Privacy

Your use of the Service is subject to our Privacy Policy, incorporated herein by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

9. Disclaimers and Limitation of Liability

9.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARKET4ME.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

Note: Some jurisdictions (including EU/UK) do not allow the exclusion of implied warranties or limitation of liability for certain types of damages. In those cases, our liability is limited to the fullest extent permitted by applicable law.

10. Indemnification

You agree to indemnify and hold harmless Market4Me.ai, its officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the Service, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for material breach of these Terms, illegal activity, or non-payment, with or without prior notice. Upon termination, your right to use the Service ceases immediately. We may retain your data for up to 90 days following termination, after which it may be permanently deleted.

12. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved by the courts of England and Wales, except where applicable law requires otherwise (including EU consumer protection rules that provide consumers with access to courts in their country of residence).

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. General

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force and effect. These Terms, together with our Privacy Policy and Refund Policy, form the entire agreement between you and us regarding the Service. Our failure to enforce any provision is not a waiver of it. You may not assign or transfer these Terms without our prior written consent; we may assign them to an affiliate or successor, including in connection with a merger, acquisition, or sale of assets.
